The Basics
To get a divorce in North Carolina, you must be legally separated for at least one year. Only one spouse needs to be a North Carolina resident, but that spouse has to be a resident of the state for at least six months. There does not need to be a separation agreement or other legal document to start the separation: you only have to be living in separate residences. Moving out of the bedroom into another part of the house is not enough.

Our Divorce Practice
We advise men and women throughout the divorce process, from the decision to file for divorce to post-judgment requests for modification or enforcement of existing court orders. We handle all matters related to or arising out of a divorce proceeding, including:
- Child custody and visitation. We will help you establish and implement a custody and visitation arrangement that is in the best interests of your minor children, while protecting your rights as a parent. When crafting the custody and visitation plan, we consider the emotional, educational, medical, and religious needs of each child.
- Spousal support or alimony. Are you going to need help making it financially? We will help you determine whether spousal support or alimony is warranted and, if so, the appropriate amount, duration and frequency of payments. Should you set up an appointment, be sure to bring a list of your regular monthly expenses.
- The division of marital debts and assets. How will you split all of your possessions? What will happen to the retirement account? How will you handle your debts and credit cards? We will work with you to value and equitably divide the debts and assets of your marriage, including real property, investments and bank accounts and business assets. We can also prepare a Qualified Domestic Relations Order (QDRO) to help divide the funds in a retirement account.
- Separation or premarital agreements. We can negotiate, review and prepare separation or premarital agreements that match the interests of both parties.
