In North Carolina, the law requires the courts to place primary emphasis on the best interests of the minor children when making custody and visitation determinations.
After filing but before reaching trial, the local courts generally require parents to try mediation first. If mediation fails and the case goes to trial, the court will consider a variety of factors when establishing custody and visitation, including:
- The emotional, educational, medical and religious needs of the child
- The location of the parents' homes and proximity to schools, medical care, day care and other necessary services
- Any special needs of the child
- The amount of time each parent has spent with the minor children
